State Involvement in War Crimes Trials

Synopsis
This lecture by Sir Geoffrey Nice examines the difficulty of assessing the responsibility of states in international war crimes courts, which deal only with the responsibility of individuals for crimes they committed. Nice asks whether this has allowed states to escape attention that should have been paid to their responsibility - as states - for conflicts, a responsibility different in kind from the responsibility of their leaders.
He looks at the evidence in the Miloševi trial and in other ICTY trials to see what this tells us about the responsibility of states, and the vulnerability of trials such as Miloševi ‘s to state interests that may run counter to open, forensic exploration of complex histories. [56 minutes]
