- Synopsis
- Shows the way in which a Social Security Appeal Tribunal deals with a claimant’s appeal against the decision of an Adjudication Officer. The central legal issue concerns the interpretation and application of the ‘cohabitiation rule’ under the Supplementary Benefits Act 1976. The proceedings illustrate the manner in which both judicial rules and administrative guidelines are used to apply the relevant statutory provisions to the facts of the case. In doing so, the difficulties of separating questions of fact and law are underlined, and the initial nature of this particular system of adjudication is demonstrated. At the same time the claimant’s own perceptions of the issues raised and the nature of the processes are also highlighted.
